This is such an open and shut case - assuming it is actually UHC sending these notices in an official capacity.
There are no consequences for deliberate DMCA misuse/abuse. It was designed as a tool to be abused solely by those with deep pockets, so it’s working exactly as intended.
There are no consequences for mistakenly issuing a notice for a piece of content you own. There are consequences for fraudulently misrepresenting yourself as the content owner.
It’s not illegal if it’s not enforced.
DMCA was entirely created for illegitimate uses though right? It’s been rife with abuse since it started.
It’s only illegitimate if you’re poor.
But the disturbing thread running through all these requests is how easy it’s become for copyright trolls to leverage the DMCA to intimidate providers
I remember this issue being pointed out by the more vocal critics of the dmca when the bill was working its way through Congress. They warned that “remove first, ask questions later” would be abused by corporations in this exact manner with effectively no recourse for people who can’t afford a lawyer for every single time there victimized by a wrongful takedown request.
And here we are, decades later, and it’s been a problem this whole time.
That was always the intention of the law.
Ted Cruz and Amy Klobachar are pushing a bill that doesn’t even have that recourse.

YouTube content creators are dealing with the same bullshit to a degree. Especially on the music side. DCMA and copyright strikes are being weaponized to shut content down someone doesn’t like, not because there’s actually infringement going on. You see that happening now too with comic/comedy commentator channels, e.g. the whole Brendan Schaub bit.
There’s a lawyer I follow on YT who speaks about this a lot.
